By accessing and using Pool-IQ ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Service Description

Pool-IQ is an AI-powered pool care platform provided by My Garden Pool (DEMIL LLC). The Service includes:

• AI-powered pool water analysis and recommendations.
• A marketplace connecting pool owners with qualified pool professionals ("Contractors").
• Product inventory tracking and ordering services.

3. Marketplace Rules

Our marketplace facilitates connections between Pool Owners and Contractors. By using the marketplace, you agree to the following:

• Bidding: Contractors provide bids based on information provided by Pool Owners. Bids are estimates and subject to change upon physical inspection.
• Communication: All project-related communication must occur through the Pool-IQ platform to ensure a record of agreements.
• Professionalism: Users must maintain professional conduct. Harassment, spam, or fraudulent behavior will result in immediate account termination.
• Independence: Contractors are independent service providers and not employees or agents of DEMIL LLC.

4. Contractor Services

Contractors using the platform represent and warrant that they:

• Possess all necessary licenses, permits, and insurance required by law to perform the services offered.
• Will provide accurate information in their profiles and bids.
• Are responsible for all taxes and legal obligations arising from their service provision.

5. Subscription and Payment

Pool-IQ offers various subscription plans for both Pool Owners and Contractors.

• Billing: Subscriptions are billed in advance on a recurring basis (monthly or annually).
• Refunds: Payments are non-refundable. You may cancel at any time, and access will continue until the end of the current billing period.
• Marketplace Fees: DEMIL LLC may charge service fees or commissions on transactions completed through the platform.

6. Content Guidelines

Users are responsible for all content posted, including job descriptions, profile information, and reviews. Content must not:

• Be defamatory, obscene, or illegal.
• Infringe on any third-party intellectual property rights.
• Contain personal contact information in public-facing areas.

7. Dispute Resolution

In the event of a dispute between a Pool Owner and a Contractor, users agree to first attempt to resolve the issue through the Pool-IQ messaging system. DEMIL LLC may, but is not obligated to, provide mediation assistance. Users release DEMIL LLC from any claims arising out of marketplace transactions.

8. Disclaimer

The materials on Pool-IQ are provided on an 'as is' basis. My Garden Pool (DEMIL LLC) makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

7. Limitations

In no event shall My Garden Pool (DEMIL LLC) or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on Pool-IQ, even if My Garden Pool (DEMIL LLC) or a My Garden Pool (DEMIL LLC) authorized representative has been notified orally or in writing of the possibility of such damage.

8. Revisions

My Garden Pool (DEMIL LLC) may revise these terms of service at any time without notice. By using this website you are agreeing to be bound by the then current version of these terms of service.
